We just purchased some more land in Kep.
Land has a hard title.
When we thumbprinted the deposit document to get the ball rolling, as per usual, we simply listed my wife as the buyer as - being a westerner - i cannot buy land etc etc. This is always the way we have done our soft titles.
We were asked by the owner for copy of wife's birth certificate which we provided and told they would commence the next step of the hard title transfer and my wife could come back in February during Tet and pay the owed amount, finalise the transfer etc
What was supposed to be a straight forward process is now turning in to a cluster fuck.
Sangkat is now saying if the person buying a hard titled land is married then they need wedding certificate and both names on the transfer.
We are telling them I am a westerner and cannot therefore be on the hard title transfer and they are saying if that is the case then wife needs to go back to the Sangkat where the family book is and get a letter saying she is single !!! We are saying no sangkat is going to issue that to a known married person etc etc.
And round we go.
In typical fashion everyone in the extended family now rendering assistance and running around like chickens without heads whereas I am saying don't stress onus is on the owner to arrange the transfer and if they cannot do it then we get our deposit back.
Still.....I know there are many here who will have bought hard titled land in their wives names so has anyone ever come across this retarded situation.
