It was interesting to read tonight of an appeal against a murder conviction in NZ, an appeal in the british courts- the last resort.The guy was convicted of hacking his wife and seven year old daughter to death with a tomahawk and was jailed eleven years ago.
The only evidence was dna on a polo shirt in his car, allegedly his wifes brain tissue.But today the evidence seemed to be dodgy, the police had shopped the thing around until they found a lab in texas that finally gave them their evidence.But the brain tissue thing seems to have been a fraud and it is not unusual for your wifes dna to be on your shirt.
But what is interesting is the juries decision to convict him.The guy was fat and most unattractive but worse was the fact that he hired a prostitute about 11pm on the night of the murder, he was in petone and the family in palmerston north.Jourors have spoken about their dislike of the accused, one woman called him a pig?
Juries ars not a good instrument for the court system, australia and nz have had so many crook murder convictions over this generation.Was the kiwi husband a mad axe murderer, is the belgian a rapist and machete murderer- we shall probably never know.The other problem with the nz case is the timing of the murders.Allegedly the husband drove from wellington to palmerston north, killed the family about7pm, ran from the house in his female disguise, dumped the evidence and drove back to wellington.I forget the distances- a long way and people said that a formula one driver couldnt do that!
Its a great story but doesnt help the belgian who looks fucked.

Add the pretty dodgy (only) payed witness declaration, a practically in-identifiable bike, and things become even more diffuse. Certainly not the level of proof a western court would demand for a custody, let alone a conviction.
@OD: Indeed, waiving around with a machete isn't that difficult, though once you start hitting wood (the skull), such a machete starts to get stuck in the wood. Do that with many repeats and it'll require some expertise to be able to do so continously. It's not a sugar cane or a finger which is being chopped of.
And no, I wasn't there, I wasn't even in the country at that time

One could just as easily speculate that a westerner killed the victim then made it look like a Khmer did it.
There is more than one witness.
The only bit of speculation I would indulge in is that Van Den Bogaerts may have been considered a flight risk.
I would suggest waiting until the French report, at least, is made publicly available.
