Ha, ha, I guess this all has to do with 'Don't start your own business in Cambodia." Who cares who shtups who.

FREE TOBY ZIEGLER!!
The German Businessman is still in the Sihanoukville jail. The German embassy and its attorney are involved as they have filed two international complaints because the Cambodian government never informed the embassy they had a German citizen in jail and the jail personnel claimed there was no German citizen in their jail . As to ownership. The German businessman, his relative and another person(small percentage), own/built the resort, that is until ownership went before a Cambodian judge and prosecutor, and the case was brought by a local tuk-tuk driver that recently sold his house for cash , and without paperwork and/or a contract is now in control of Moonlight Resort. SeaCambodia is no more as their new ferry was impounded by customs for not paying import duty that was supposedly paid to a customs official(s).(May be out of impound, but word is it may or may not run.) I wonder how many of the other fast ferry companies can show they paid the import duties? SeaCamboida ownership? German/Australian. To bad Toby isn't from China as none of this probably would have happened and he would be free and living with his wife and children. Unless you are Chinese with big money (black money), it seems its real risky to do business in Cambodia, specially when you offer a superior service and greedy eyes look your way. In the past I have had offers to go into business with Cambodian friends (that I would trust with my life), but I turned then down as it seems the court system here does not look favorably on Barang businessmen.

You do know Toby's previous partner hung himself , and that Sea Cambodia owes thousands of dollars around town , and now Toby claims those debt's are not his responsibilty . And the Tuktuk driver has not driven tuktuk s for many years , he is a well known and succesful businessman , Toby is in jail for ripping people off , and trying to rip the government off , by not appyling for a import permit for a boat . So, what have I learned from all your posts in this and other topics?
- Try to hide your western identity. Let people think it is a Khmer business.
- Do not show off
- Do not show how successful you are.
- Don't try to piss of or do not compete with Khmer with a lot of influence
- Do not make debts
- Avoid going to court
So stay low, do your thing and stay out of trouble.

I don't know how long you live in Cambodia now, but the western world got spoilt. Teens have smartphones, tablets, motorcycles and everything you can wish for. But it is never enough. They do not want to do any work in the house or garden. Like to party and sleep till the middle of the day.
I really tried to raise them with good values and working attitude, and they are pretty decent, I have seen much worse, but still.
Everyone here in Europe got used to a very good life but most of them do not want to take restorability. Daddy has to take care of everything. Now they are grown and (almost) have a life of their own.
Please don't think I am rich. I have build most of it myself and had to work very hard to keep everything going.

I don't know how long you have been an adult...guessing still to get there, but kids have always been that way. The only thing that changes is what they ask for, and the difficult job of the adult parent is to be the adult parent. Sorry. Whining about demanding kids gets zero sympathy from me. I am grateful not to have children because I am a tad selfish but you can bet i would suck it up if i happened to bear a child.
The parental role is to teach the child, provide boundaries and guidelines. they don't just magic out of the fuckin womb that way.

Sattroni: You may want to check your facts and not just bar-room gossip. Ex-tuk-tuk driver is a rip-off, not a businessman. Businessmen don't sell their house for cash just before going into court and claiming ownership of a resort with no paperwork/contract. Toby built and designed Moonlight Resort and his family and one other minor partner own it . There is more to this case than I can divulge as Toby is still in jail, and I like living here and/or living period. Suffice to say that barang attorneys are just as corrupt as some Khmer officials are purported to be. As to SeaCambodia and their fast ferry. Bad legal advice, mishandling and mistakes were made in the building of the vessel in Thailand, export from Thailand and handling of the customs duty, but not by Toby. That said, the German embassy and their attorney have gone the extra mile in filing two complaints. I would never see the American embassy doing this for me.

It appears, this sad story shows the futility avoiding death and taxes.
Yes, I have to add,
1. Never directly compete with this government without some juice,
2. Know how the old boy network here works, it appears that enterprising Tuk Tuk driver knows when to go all in with a "govt gift." I'm sure that's a down payment for future taxes he intends to pay the govt.
As much as I like to support Cambodia, I must say, Cambodia is NO LONGER TAX FREE. Low taxes sure, for needed developments like infrastructure, electricity, etc., but no longer the "palm beaches and nice, simple villagers" destination for investment.
Cambodia is moving up, and so are the goal posts, I'm afraid.
It may be enticing but dangerous to think Cambodia is still tax free. Sadly, it is not. Fair warning, going into 2018.
DO NOT go against a government run business unless all your t's are crossed and i's are dotted. I say this looking at this case and at the CD.

Exactly the wrong thing to do , once embassies , lawyers get involved , the police , prosecuter , court officials just dig there heels in , they cannot be bullied or intimidated . When you cross swords with the Khmer establishment , you don't bring anyone in to bat for you , you just bring cash , pay your way out , and move on .
