I just read an interesting option on a Dutch forum.
I am Dutch and I am planning to live in Cambodia and start a business there. But there are some tax and Healthcare issues.
If you officially register in Cambodia then you have 2 problems, my pension will not be fully paid. And due to lack off tax agreements you have to pay double tax in both the Netherlands and Cambodia.
Someone took the following construction as the best.
Live in Cambodia - register in Thailand with excellent and affordable health Insurance ($400 a year in my case) - register business in Cambodia.
This seems to be possible end legal. It would keep my full pension, avoid double taxes and I really don't mind going to Thailand a couple of times a year . And when you register in Thailand you have to go abroad every 3 months and that I was planning to do as well
Has anyone experience in this kind of situation?

I doubt whether you could register a business in if you're not actually a resident there. But if you have a Khmer partner and want to register in her/his name ,why not

Re-reading it, I think that you want to live in Cambodia, start (and register) a business here, but register yourself with your embassy in Thailand, and then visit Thailand once every three months to say hi. Ja?
I can register a Cambodian business without officially (living) registering in Cambodia. I know for sure that is possible.
I want to live in Cambodia most of the time. So register Cambodian company. Live part time in Thailand and register there as inhabitant and have Thai Health Insurance is also possible.
So for the Dutch and Thai government I live in Thailand officially . Have business visa to stay in Cambodia and have Non-Immigrant visum for Thailand.

I question that. As far as i know pensions are not (yet) taxed in Cambodia, so only the income of your business would be taxed.james123 wrote:I just read an interesting option on a Dutch forum.

To register in Thailand you need proof of residence. Besides a rental contract your passport is your best bet. It shows where you've been. One look in your passport during your 3 monthly report to the authorities and they can see where you really spent your time, and you lose your status in Thailand, which they will probably report to the dutch authorities, and they will probably kindly ask you to refund some of your pension.james123 wrote: Someone took the following construction as the best.

The days of wild west living below the radar are kind of ending. Better stick to the rules if you want to spend a longer period of worryfree time here.

Also, health insurance cover will need to be global cover if you aren’t living there - why do you think Thai health insurance is better?
If Thailand considers people coming on a tourist visa an inhabitant that seems a loophole that's not going to last forever, it might also not be accepted by the time you start receiving your retirement money. Since people living in certain countries receive a reduced amount of money, they will ask for solid proof of where you actually are living. It is not a tourist visa for thailand, it is a Non-immigrant “O” Multiple entry . Valid 1 year.
It is not my pension with double tax. My pension will be cut in Cambodia by 50% due to Dutch new law . Not in Thailand. (This is really true)
It is the profit of the Cambodian company with double tax, both in The Netherlands and in Cambodia because there is no Tax agreement. (This is really true too)
Yes, i need a house/room rent contract for Thai Health care Insurance and visa. This insurance is also valid during travel in Cambodia (I checked that). And by what I know there is no obligation tot stay a minimum amount of time in Thailand with a non-immigrant visa. The only obligation is to go out the country every 90 day.. But I don't mind spending more time in Thailand . I like it there too.

Pension reduction has nothing to do with tax.... If you permanently and legally move to Cambodia (and you have legal proof) you will not be taxed for any income in the Netherlands anymore. Also not for your Cambodian income.james123 wrote:My reply got lost, so again:

Pretending to live in Thailand, while actually living in Cambodia, and using Thai health insurance that covers 'trips to Cambodia', while having a pension from the Netherlands (cutting pensions for people living in Cambodia) and not letting them know where you really reside seems like a major attempt to fly below the radar. No I disagree. There are lots and lots of people living in one country and working in another. It this moment I have 2 polish construction workers working for me. They live in Poland, have thier Health Insurance there. They come here and work 6-8 weeks and go home. They are registered in Poland, work and stay (legally) more time in The Netherlands. Thats exactly the same. Again it is not the pension with tax problems. It is the earnings in Cambodia. Really. They will be taxed in Cambodia and also in the Netherlands. It is insane but true!
But Poland is their home country. Neither Thailand or Cambodia is yours.

Are u over 50? Married to a thai?
If ur not working, and have a wp, will not get a 1 year multiple entry visa.
Plus unless ur thai or have a wp you can not get thai insurance. You could get thru Bupa. Best u can do is 3 tourist visa in a row and than 30 day extensions on each one so ,...9 months.
Total than they will start questioning what ur doing. And how will u register a business in cambodia?
you have not thought this thru.
ps. To get a certificate of residency you need provide a copy of lease, copy of landlords id card and copy of landlords taam bien baan, house paper.

How will the Netherlands tax department know about what you are earning in Cambodia, or even that you are working/own a business in Cambodia...unless you inform them?
I'm not a negative person, I encourage people all the time...it's usually to f**k off! But, whatever.
I have been preparing and thinking this through for a long but the Thailand/Cambodian combination came today on the table.
I am thinking of living (partly) in Thailand or Cambodia for a while now. I have already a project in Siem Reap running. I can not own a Thai company and for sure I am not setting up a company with a Thai partner . So I already decided to set up a Cambodian company, which is not difficult anymore. I will do that as soon as our first product is finished.
For the Thai visum, I did n't do a lot of research till now. It seems that a business visa is for me the best choise, although I am over 50. But having every year 800.000 baht on my bank account is difficult. I need my money to do business. My project in Siem Reap will extent to Thailand as well and does justify a Thai Business visa. With that I can be a resident and have health care.
Not telling the Dutch goverment about earnings in Cambodia is fraud and dangerous. I do not mind bending the rules a little, but do no fraud.
