Hi Guys
No doubt you can help.
I have been with a cambodian girl now for over a year and we are discussing bringing her to Australia permanently.
She has been separated from her husband for more than 3 years but isnt officially divorced.
I have done a search on here and see that it should be as simple as paying a fee and filling in a form.
She is telling me others in the village are saying it will cost her $600, she is going to Prey Veng tomorrow to get it done but has $100 on her which should be enough.
If what she is saying is true that she expect to be extorted in prey veng what are the options if she cant get it done tomorrow
Is there a lwayer that will do it for $100-$150 , i couldnt imagine it being more than an hours work to lodge the paperwork

I think it partly depends on whether her marriage was just registered at songkat level (very common and it's cheaper to do) or whether it was registered on the national register. Songkat level is very cheap to change, national level obviously more expensive.
If the local songkat suspect that she wants to end her marriage officially because she now has a barang partner, they can get quite greedy. I would guess that they already know from some busybody that she has a new barang partner. Hence the outrageous quotes to end it.

If she was officially married with her husband, she'll need to get the marriage dissolved by a court, I suppose by the provincial court in the province where they registered their marriage.
My divorce experience was straightforward as my ex and I had agreed to get divorced, so we only needed to submit a divorce agreement at the Phnom Penh Municipal Court, as our marriage was registered in Phnom Penh.
The court clerk will meet both spouses to check that they do agree to get divorced, then a judge will review the request and issue an official court decision.
The submission fee cost very little (KHR5,000 or 10,000, can't remember). The informal fee was USD300.00 though and my ex took care of it.

It's actually only a procedure to request the sangkat council to publish a notice about the marriage (in case anybody objects to it) and to allow the wedding ceremony to take place.
After the wedding ceremony, then the newlyweds are expected to register their marriage officially ("jos etat civil" - which comes from the French "état civil") to make the marriage binding.

The OP doesn't mention whether the husband wants a divorce. I find it hard to believe a married person can walk into a court clerk's office and fill out a form and pay $50 or so and become divorced just like that. Then again, it is Cambodia.

If the cost is $600 because it has to go through the courts so be it, however i thought it was a case of them knowing she has a foreign partner. However she has told me two other girls in the village paid this. We haven't heard anything official as she is going tomorrow, it just didn't sound right to me .
I told her to pay up to $200 and if they don't accept that well get a lawyer to do it properly.

Fact. 100% of divorces occur due to marriage.

Before you spend hundreds on these documents, check with your embassy what they really need to process it all. Don't forget if they for instance want the document legalized by MFA in Cambodia the MFA will not do that for you.
