Australian Citizen by descent - travel to Australia on Cambodian Passport
Hi All
This is my first post here, so I am sorry if this may have been covered before. I live in Australia and my brother (who died last year) has a daughter to a Cambodian lady. Since his death, his partner and I have discussed bringing their daughter to Australia to live with me and be educated here.
Given my sister-in-law is unable to read and write Khmer and lives in a province about 1.5 hours from Sihanoukville, I am trying to work out the easiest and fastest way to bring the child to Australia. At this point, I am contemplating applying for Citizenship by descent in Phnom Penh (with the mother and niece travelling up from S'ville) at the same time as applying for a Cambodian passport, thinking that if we can arrange for these two documents at around the same time, I may be able to then return a few months later and bring my niece to Australia and apply for her Australian passport here.
Does anyone have any experience of travelling with a child that is an Australian Citizen entering Australia on a Cambodian passport?
I can apply for an Australian passport in Phnom Penh once the citizenship comes through, but it will mean 3 extra journeys to and from Cambodia as opposed to possibly 2 (if the Australian citizenship/Cambodian passport combo works). Naturally my funds (and time) are not limitless
Any advice?

your niece travelling to australia on a cambodian passport shouldn't be a problem..my missus is a permanent resident and she travels on her cambodian passport back and forth no problems..
if you're escorting her make sure there's no problems there..
also make sure that mother and daughter bring with them all the relevant documents..embassy should provide you with a checklist..

Do you still need to get a visa for your wife when you are entering Australia with the Australian citizenship?
Also, with me escorting my niece - should I get some kind of notarised letter signed by my sister-in-law to say I have her permission to take the child overseas or something like that, do you think?
Would there be more trouble from that perspective in leaving Cambodia or on arrival in Australia (or both)?

If citizenship by descent is granted, apply immediately for an Australian passport. There is no requirement for the child to have a Cambodian passport to travel out of Cambodia if they have dual citizenship.
The application time for both is very quick. I had citizenship completed in 4 days, and the passport a week later.
You will need the hospital birth certificate, and the Sangkat birth certificate, both of which should list your late brother as the father.

in terms of the child travelling with you i couldn't say..i'd check with the authorities..in australia immigration department and from the cambodian side maybe the embassy in canberra can advise you..
if the turnaround for citizenship and passport is quick as suggested by previous poster maybe that's the way to go...

Get the kids Aussie PP before attempting to travel, otherwise a Visa will be required which can take several weeks and given the circumstances may be difficult to obtain.
Hope you're brother managed to obtain the child's official Cambodian Birth Certificate with his name included prior to passing. Shame he didn't arrange the kids CBD and Aussie passport.

There are ways around having to do it back at the mothers Sangkat - however - again - they are frustrating and need any Khmers assisting you to be on point with the way they can deal with local authorities.
Check your private K440 mail for information that may help....

Many Aussies might not realise the "permanent" partner visa that spouses get in Australia is actually effectively only a multi entry 5 year travel allowance. After that you need to apply to "renew" it and the forms have some bloody interesting/challenging questions if your partner has not actually lived in Australia for a 2 years full time stretch since getting her permanent Visa.

So she is living permanently in Australia on a subclass 100 ?
Citizenship requires 4 years of ft residency as far as I understand it. Not sure where you are getting 12-18 months.

yes 4 years of residency, not necessarily as a permanent resident..she's been living continuously in oz since 2012...
the wait times i think have only relatively recently blown out to 12-18 months..they may even be on their website..it's certainly what they advised when i rang up...

ps. you may be thinking of dutton's fiasco to prolong the wait times for citizenship...it didn't get past the senate so it was more of the same...eligibility to apply 2 years after grant of permanent visa...

But total 4 years qualifying residence in Australia.
The two years on the provisional visa counts.
Also must be physically resident in Australia for 9 months out of the 12 months prior to citizenship application.
Been there done that.
Partner Visa application took 8 weeks. Citizenship granted within 6 months of application. Aussie passport available within 20 hours of citizenship ceremony.
Note to self: Must be nice to morons.
