Divorce
Hello all,
I am looking for advice from anyone who has been legally married in the UK (Scotland specific) that has, while living in Cambodia, applied for a divorce. I am thoroughly confused as to how I am supposed to go about the process?! To complicate the situation, I am in a same-sex marriage with my wife and we were married at the UK Embassy here in Phnom Penh. We have lived in Cambodia for the entirety of our marriage, as well as, 5 out of the 6 years of our relationship- we have never lived in the UK. Cambodia does not recognize same-sex marriage so we can't apply for divorce here. I am a US citizen and my wife is a dual US-UK citizen.
I am desperate to get this shit sorted out as soon as possible, PLEASE HELP ME.
Thanks bunches,

i am confused:
if Cambodia does not recognize same-sex marriage , how did u get married?
i'd go back an ask at the embassy if they officiated the marriage that is not legal in Cambodia

1. Retain a lawyer in the UK
2. Instruct them to start divorce proceedings
3. Sign the paperwork that he couriers over to you and return it.
4. Repeat signing and paying until finalised

Since Cambodia does not recognize same-sex marriage, the UK Embassy offers same-sex couples the ability to get married at the Embassy to counter Cambodia's blatant LGBTQI discrimination (don't get me wrong, Cambodia is very tolerant compared to our neighbors, but since Cambodia doesn't allow same-sex marriage, the UK Embassy gives this right to it's citizen who live abroad). I have contacted the Embassy but they do not have legal jurisdiction over the issue of divorce and have advised me to seek legal counsel.
I have contacted dozens of law firms in the UK, and have received nothing but automated or 'copy and paste' responses. All of which have informed me that I need to pay hundreds of pounds for just "consultation"- with no legal advice.
My wife is a lying, cheating, self involved, denier, who asked for a divorce over Google Hangouts by saying, and I quote, "I want to break up with you"- because apparently she has the mental capacity of a 14-year-old in a 30-something-year-old's body. In addition, she has moved out of our house and left me with the lease, all of the bills, and our animals and has the audacity to ask me not to file for divorce right now because "she can't afford it".
So, I suppose I should have been more clear;
Is it possible to obtain a divorce in the UK and make your spouse monetarily pay for every single penny of it?
Any advice would be much appreciated.

I got married in Australia to a UK citizen, and it is very possible to get a divorce in the UK, as I did. They won't be paying for it though. You will.MackenzieNicole wrote:Since Cambodia does not recognize same-sex marriage, the UK Embassy offers same-sex couples the ability to get married at the Embassy to counter Cambodia's blatant LGBTQI discrimination (don't get me wrong, Cambodia is very tolerant compared to our neighbors, but since Cambodia doesn't allow same-sex marriage, the UK Embassy gives this right to it's citizen who live abroad). I went to a South Yorkshire Registrar. She was willing, so she signed the papers. If she is not willing, there will be more papers, but you can do it. You'll have to present her with the papers, too.
Even though my case is different, just find out where she is from and go to that place and explain and file. They were quite happy to help me. The UK embassy won't help you. They can marry you, not divorce you.

I guess I should add that it might even be easier than you think. I got married to a UK girl in Australia as a US Citizen. I then traveled to the UK on a Trinidadian passport, but left my wife and went to Scotland, then to China, then started proceedings as a Trinidadian citizen through a friend in the UK (South Yorkshire) that worked for the council. I did that from China. He scanned and emailed me the papers, and I signed them and he returned them to the registrar and she signed them. So I didn't actually set foot in the UK for the divorce.
Just send a good friend to a registrar and have them explain the situation and ask what you should do. They should know.
I like your avatar. I'm not allowed to post in here, but I don't care.

Under australian law as an Australian citizen you can serve your ex divorce papers no matter what country you were married in or where either of you live after one year of not living together. They can refuse to sign but once served... You're out.
UK might have similar.

They absolutely do not, Ricecakes, and it's been in the news lately in the UK. Especially and specifically for women. I'll try and find the link.ricecakes wrote:Under australian law as an Australian citizen you can serve your ex divorce papers no matter what country you were married in or where either of you live after one year of not living together. Yes, proper advice given above (Playboy).MackenzieNicole wrote: Is it possible to obtain a divorce in the UK
No, not in your case both being outside the UK.MackenzieNicole wrote: and make your spouse monetarily pay for every single penny of it?
Plus, the costs of taking that case to court is probably higher than 50% of the divorce fee.
Just an idea, but have you thought about contacting the UK Citizens Advice Bureau?
I don't know how this works when you are living outside the UK. You may wish to overlook mentioning your current location.

Can't you invalidate the marriage with a recent certificate from Cambodian authorities recognizing your single status? You can't get divorced but you can get confirmed being single. Just a thought.
Am I the only divorcee seeing the irony in even a woman not being able to put up with another woman's shit any longer?
