Good morning members, I’m looking for an experienced ex-pat lawyer in Phnom Penh whose area of expertise is facilitating a post-divorce property split of assets in Phnom Penh. My ex is Cambodian and I’m an ex-pat. Any recommendations would be greatly appreciated.

Why only an expat lawyer? Why not a local? If you go to one of the large foreign law firms (Sciaroni, DFDL, etc), they will just sub all the work to a Cambodian anyways and charge you more.
It sounds like you're already divorced. Are the assets in your name or hers?
I could be wrong, but I'm guessing the assets are land (and/or business) that is in her name and you're looking to recover what you can?

Hi Miguelito, many thanks for your response, yes we were divorced in Australia one month ago. She's been a permanent resident of Oz for the past nine years, but spent much of that time in Phnom Penh. You are quite correct in that the assets are land, businesses and apartments, all in her name. So any lawyer, ex-pat or local who is able to facilitate a fair asset split (50-50 for example) is who I'm looking for. What's happened has happened, it's where to go from here...

Are you saying that in Cambodia, what's hers is hers?
Because I imagine that as for assets of the divorce in Australia, what's his is . . . hers.

That's exactly what I'm saying. It's in her name not in both. Unless she gives up a stake on a voluntary basis, which would make history for a Khmer woman, I don't see what a lawyer could do. Been there (not) done that.
My understanding is that if the assets were acquired after the marriage, then they should be divided between husband and wife in case of divorce. And when you buy land, you must state whether or not you are married.
Sounds like there's a fair few assets at stake here. Well worth talking to a good lawyer.

if she spent most of her time in cambo whilst being a permanent resident of aust and is involved with another, be cautious as these sometimes end very badly if youre in her country

Don't ever expect to get anything you put into someone else's name returned to you here in Cambodia.
