Need the facts about foreigner divorcing Cambodian
Hi all,
Turns out I need the formalise the separation of my bitch wife of 10 years ago by divorcing her in Cambodia.
Ive tried to do this numerous times and failed each time for various reasons.
I have the marriage certificate and all the documents that my embassy required when we first married and sought a visa to Australia.
I AM TOLD that all I need to do is take these documents to the village where we were married, and as the divorce is consensual (ex-wife will be attending and not arguing), we fill out some forms and it is done.
Im worried that this may not be true. That is.. perhaps we need to then take the forms signed at the commune to the province... or to the dept in Phnom Penh.
Can anyone who has actually done this in the village give me some advice on this please?

Were you officially married...approved by and registered with the MoFA and MoI? Or just married unofficially at the Sangkat level?
I don't know anything about divorce in Cambodia, but I imagine the procedures will depend on your exact circumstances as above.

You can divorce formally in Australia online. Cheap. No need to go to Cambodia.
When completed you will receive your decree nisi by mail, you can send/email her a copy.
All you need is your marriage certificate, ask for more details.

Not sure about Cambodia, but to divorce in Thailand i had to go to family court not just the amphur ( equivalent to the village goverment office in Cambodia) where i was married.
Than had to take the court divorce papers to the us embassy and register the divorce. ( since u were trying to get her into Oz u registered the marriage at the embassy)

I don't know if the same applies for a marriage between a Khmer and a foreigner, but that's what I know about getting divorced for two Khmers.
The marriage needs to be terminated by the court (if in PP, the PP Municipal court. If in the province, I assume the provincial court?), even upon mutual agreement.
Divorce on mutual agreement is usually almost hassle-free (if you have the cash)
What is needed:
1- agreement between the spouses about getting divorced, for X reasons. If they have children, joint assets, debts, agree to provide alimonies, it will need to be written down.
2- letter to request the court to dissolve the marriage in accordance with the agreement.
3- Copies of marriage certificate, ID documents for each, birth certificate of children if any.
4- Cash.
For 1 and 2, if in PP, the photocopy shops right next to the PP court can type them for you. They do it routinely. Don't know about the provinces.
The papers are then submitted to the court, signed/thumbprinted there, pay KHR 5,000 for the submission fee (at least that's in PP).
Then there's an appointment with the clerk of the court who will file the demand, verify the request and all information with both spouses and make sure that they want to divorce consensually and not under any coercion. Another KHR 150,000 is paid at this stage (fee or tax).
Then, the couple can let it go its course (no extra payment) which can take a while, or pay an extra and the court will examine your demand, grant your request and issue its decision in less than a week.
Then you'll get a copy of the judgment, which you can use for administrative purposes, etc.
