That is an American law, isn't it? I wonder what weight it would carry in Cambodian court if somebody decided to sue. It would appear that the proposed Cambodian cyber crimes law contains no such similar protection as Section 230 of the US law. In fact, Article 28 of the proposed Cambodian law, it punishes both "publications or continuation of publication" of defamatory, slanderous, morally damaging, seditious, pornographic, etc etc stuff, thereby seemingly making ISPs and hosts which 'continue publication' of slanderous material as responsible as the original publisher/writer. I don't think that the Cambodian law has been passed yet, but if there was a defamation suit filed in Cambodian court, I wonder which law would hold more weight in the courts eye's: an American law, or a proposed Cambodian law, or perhaps even the current defamation laws which don't specify online protections (or the lack thereof.) Under the current Cambodian law, I don't think there is any such protection as Section 230 either, or any protection against being sued for what is said online, though I could be wrong about that. And I don't think the Cambodian court would care much where a site is hosted, if both the suer and the sued are in-country. Just thinking out loud...scobienz wrote:..It's a well established legal doctrine - covered by Section 230 of the Communications Decency Act - that forum owners are not liable for comments made by posters on the forum. If they were, the shareholders of Facebook and Twitter would be in court every minute of every day.
In your case, the forum manager made libellous comments herself.

I'm guessing forum owners would need to comply with certain requests from certain companies and organizations if need be, and if they refused only then would legal action be taken.
The criminal threads get a lot of views and replies. I've only seen a few Gawkeresque threads making a full of people (with photos) who haven't committed a crime.

I wonder how many would be fucked if criminal records were checked?

Never mind that. At the very least, do thorough employment reference checks. That would weed out many hucksters and shysters. Right vlad?
I noticed you conveniently left out a few doozies from your linked in profile. Though to be fair it wouldn't be practical to list all 42 schools you've trod through.
One benefit of that having that breadth of employment is that it makes it a cinch to cherry pick work history when it comes time to dust off the old CV.

Vlad, for a guy that is critical of all things and cannot understand the difference between "learnt and learned" I suspect you do not understand journalism....
Both are acceptable as either the past simple or as a past participle.

There is no 'bad' or ' good' lesson, they are all valuable.
Tell us.
'Learned' is more common in the "US of A." 'Learnt' is more common outside the "US of A."erictheking wrote:Well, I suspect you're in the wrong here.dirtymacca wrote:Vlad, for a guy that is critical of all things and cannot understand the difference between "learnt and learned" I suspect you do not understand journalism....vladimir wrote:Serious question: how come a newspaper editor can be held liable for comments published in Letters to the editor, for example, or an outsourced editorial, but not a forum owner?

Seems like a fairly accurate description. Maybe we should have a vote.Starving Pelican wrote:This is one of the occasions in which I agree with scobienz. Would you have me park every such post - indeed every post made here - to fact check and verify from a legal standpoint? That's ridiculous.
440 is neither morally nor legally responsible for the posts that posters make. You - the posters are responsible for your posts. I know that notion of personal responsibility is anathema to some, but such is life. I'm not your moral guardian. It's an interactive website in which people like you post whatever random bollocks springs to mind and for which you - if called upon - should be held accountable.
