You are correct I am not a lawyer. The arguement of whether you are active or passive is the crunch. Regardless of what you have said, quoted or written, participating makes you active in the publication.
Most companies owning a forum have an employee policy- no participation.

It doesn't matter how many times you say that DF, it's still not legally correct. No offence, but I'll take the legal opinion of qualified specialist IT lawyers' word over an anonymous poster on the forum.
If I had a dollar for every time someone tried to insist I was liable for the bollocks that gets posted here daily, I'd be able to pay for every civil suit ever threatened against us. There is a reason no one has ever followed through with threats of legal action - after investigating, they know have no basis in law, despite their bragging that they have got legal counsel in Cambodia.

most diddle and fiddle for years and are very good at living under the radar.
most are never caught or reported.
i agree that nobody should get unsupervised access, but thats not realistically enforcable no matter how good your security is. how do you get anything done if everyones guilty and you cant prove them innocent?

It might not be easy, but it is enforceable. There are protocols that should have been observed. If this was a one-off attack I could give the organization the benefit of the doubt, but from what they reported it was over an extended period.
