It appears, this sad story shows the futility avoiding death and taxes.
Yes, I have to add,
1. Never directly compete with this government without some juice,
2. Know how the old boy network here works, it appears that enterprising Tuk Tuk driver knows when to go all in with a "govt gift." I'm sure that's a down payment for future taxes he intends to pay the govt.
As much as I like to support Cambodia, I must say, Cambodia is NO LONGER TAX FREE. Low taxes sure, for needed developments like infrastructure, electricity, etc., but no longer the "palm beaches and nice, simple villagers" destination for investment.
Cambodia is moving up, and so are the goal posts, I'm afraid.
It may be enticing but dangerous to think Cambodia is still tax free. Sadly, it is not. Fair warning, going into 2018.
DO NOT go against a government run business unless all your t's are crossed and i's are dotted. I say this looking at this case and at the CD.

Exactly the wrong thing to do , once embassies , lawyers get involved , the police , prosecuter , court officials just dig there heels in , they cannot be bullied or intimidated . If Toby is the owner of the company, he is responsible for those things. Doesn't matter who he hired to represent his company. That's true in Cambodia and every industrialized country.
That's why when sexual harassment happens in some office in NY, the victim sues the company. The company is responsible for its actions, it is its own legal entity.
I don't doubt there are problems, but surely you understand that you are only seeing this from only one perspective. For all we know, the Cambodian businessman would defend himself by saying Toby promised him he'd be a partner and when he was a tuk tuk driver back then, he didn't think about getting that promise on a legal document. He just trusted him.
That's just one example. But you can imagine if that were the case, then in the same way Toby snuck out of his obligations through legal technicalities, it would stand to reason the businessman would pursue any/every legal avenue to correct the situation.
Anyways, I don't know any of these people. Just seems strange. I do hope Toby is safe and gets out asap.
