The USA has filed an opposition brief to Rife's request to be released from pretrial detention.
There are a few interested bits in the document, and I'd say that things are suddenly looking a lot worse for Rife.
The prosecution starts out by noting that "In September 2012, the Defendant traveled to Cambodia and soon after, with no education, experience, or other qualifications, found a job teaching young children." That doesn't make Cambodia look very good.
The prosecution mentions that Rife was fired from Hi Bridge for "mishandling students" and the phrase is put in quotes like that's what the Hi Bridge termination paperwork actually says. "Mishandling students." That's a great cover up euphemism for sexual molestation.
More importantly, we learned that Homeland Security Investigations Special Agent Michael Romagnoli, who submitted the affidavit supporting charges against Rife, was holding out on us quite a bit.
Rife was charged on January 25. Apparently, Romagnoli interviewed Rife one day earlier, on January 24. Like the Feds showed up at Rife's door and he voluntarily invited them in and willingly talked to them. And he said this:
Goddamnit, Micky. This is why no one should ever talk to the police. Ever.

It turns out you were right. Rife did not handle his computer wisely.Wayward Woods wrote: ↑Thu Jan 31, 2019 1:29 pmHe is from Kentucky, I wouldn’t give him too much credit for doing anything wisely...gavinmac wrote:Speaking of child porn, I wonder why the customs and border protection officers didn’t seize Rife’s electronic devices and perform a forensic search of them for child porn. I would say they had “reasonable suspicion” to do so, knowing he was returning from Cambodia and had been fired from a job there for molesting children and was now lying about it. I assume they at least seized them when they arrested him. Of course, he could have deleted everything by then if he realized from his secondary inspection at the airport that the feds were on to him.
If you look at the bottom of page 3 of this filing you will see we have a little more information on the fate of Rife's computer, the one that I thought Customs and Border Protection officers probably should have seized from him and searched for kiddie porn when he landed in Chicago. They didn't do that, they let him leave with the computer.
When HSI Special Agent Romagnoli visited with Rife on January 24, he asked him where his laptop was. Rife told him he sold it at the airport in Chicago. Note that lying to federal officers is a felony warranting up to five years in prison.
The Feds found the laptop; Rife had hidden in the house of his twin brother, a paroled sex offender probably subject to having his house searched at any time without a warrant, and you know, one of the first places the Feds would look for it, since Micky had told CBP he might go live there.
Rife is a stupid Appalachian hillbilly pedophile who's gonna get convicted and serve a long time in prison.

I've posted this before. I'll post it again if anyone hasn't seen it. It's a very compelling argument as to why you should never talk to the police. If Rife has watched this and kept his mouth shut then he might have beaten the rap.

Because landing at an airport, getting your computer checked, and then selling it immediately at that airport on your layover (huh?) is definitely plausible.gavinmac wrote: ↑Sun Mar 03, 2019 4:12 pmIt turns out you were right. As the computer was found at his brother’s house, who is a registered sex offender, will the brother be charged as well?

No, but when I flew into LAX and two officers met me at the plane door and asked "Are you traveling alone?" I responded "Why are you asking me questions?"

I read the brief and a few interesting points are included:
- This clears up the girlfriend thing: "Rife’s ex-girlfriend also feared Rife was possibly abusing their 3-year-old adopted child, although his current girlfriend and current custodian of the child disagreed." But, how did a single (as in, not married) white guy in Cambodia adopt a child? Was it a legal adoption?
- "As early as 2013, the FBI was made aware of Rife’s “unusual behavior with students,” and on several occasions investigated these allegations." If the FBI had been investigating these incidents since 2013, I wonder why the 2018 notification from the ex gf seems to be the catalyst here.
And, yea, looks like he'll be in prison for a while: "The United States can think of very few scenarios more dangerous to members of the community than releasing a person who despite no college education, purported to be a teacher, put himself in a position where he was in charge of numerous small children, and then sexually assaulted them."

No, it wasn't a real adoption.
I still can't get over why, if he did it, he would tell a federal officer who showed up at his house "Oh, yeah, I totally molested those girls."
Did he think he had gotten away with it and that American law enforcement officers had no power to arrest him for it?

A few developments in the Rife case.
1. The parties have agreed to delay the trial date for a few months
2. The district court judge has denied Rife's request to be released and allowed to live with his mom pending trial. He'll stay locked up until he is charged
3. Rife's lawyers have filed a motion to dismiss the indictment, arguing that the PROTECT ACT, which criminalizes sex with children by Americans in foreign countries, is unconstitutional.
The gist of the argument is that the U.S. government's jurisdiction to prosecute Americans who travel abroad to have sex is based on the foreign commerce clause of the constitution, and Rife's alleged molestation of the girls had no relation to foreign commerce, because: (a) he was not a sex tourist but a longtime resident of Cambodia, and (b) he didn't pay the girls for sex.
Rife isn't going to win this argument, at least not at the district court level. He's also not likely to win it if he is convicted and appeals.

Wow, not much respect for the US govt before I read this, even less now, I guess it is all just about money.gavinmac wrote: ↑Sat Mar 16, 2019 2:25 pmThe gist of the argument is that the U.S. government's jurisdiction to prosecute Americans who travel abroad to have sex is based on the foreign commerce clause of the constitution, and Rife's alleged molestation of the girls had no relation to foreign commerce, because: (a) he was not a sex tourist but a longtime resident of Cambodia, and (b) he didn't pay the girls for sex.
Fuck little children if you like, just don't mess with the cash flow.

That's his lawyer's argument, not the government's argument. The government wants to lock him up for 30+ years. The USA is one of the very few (only?) countries that prosecutes its citizens back home for having sex with children abroad. So I don't think this is a good thread for you to claim Uncle Sam is more interested in money than in protecting children.

Also, I think Australia prosecutes its citizens for the same crimes.
Yes Australia does.
I refuse to go out with nothing more than a whimper followed by a small farting sound and a shit stain on my bed sheets..
Just thought I'd share that with you.
