The Ministry of Information of the Kingdom of Cambodia (ITC) explained that as of last week there were five major IT crimes in Cambodia Today, the technical team would like to explain the "Social Media Defamation" offense, distribute it to the public and prevent it.
The Department of Information Technology stated that defamation on social media is the posting of content, images, videos, fabrications of malicious deeds or malicious intent against individuals, companies or institutions using the following means:
- Social media ( Facebook, Twitter, Instagram or Youtube)
- Website (e-commerce platform or blog)
- Messenger (Messenger WhatsApp Telegram Line or WeChat).
Most of the perpetrators of the crime were aware that posting or sharing content, images, videos, defamation of a person, company or institution was a right to comment, but they did not understand the source and verify the authenticity of the information shared or posted.
So, to join the prevention of crime of "social media defamation" is to start with every citizen by adhering to the posting of articles, photos and videos, so there is constructive and noble content.
Pursuant to the Penal Code of the Kingdom of Cambodia:
- Article 305 "Public Defamation:" states that any exaggeration or wrongful dismissal of any act that infringes on the honor or reputation of an individual or institution is defamation and punishable by fines from 100,000 Riels to 10,000,000 Riels.
-Article 502 "Insults" states: Insults are gestures, writings, drawings or objects that affect the dignity of the person. An insult to a public servant or to a public servant by election, within the scope of the function or on the occasion of his performance, shall be punishable by imprisonment from one (1) to six (6) days; Fines range from 1,000 (1,000) Riels to 100,000 Riels.
