I'm not an American but as far as I know, to get a US passport from your parent, don't you both have to submit a DNA test? Surely if that is the case, it negates a birth certificate? That would at least help the kid out massively as he'd be able to travel there if and when he wanted to, now or in the future.
If there is no birth certificate then he is not a legal custodian. The mother is by default but the father can't be without the BC. I guess he would need to have that resolved by the court in the Philippines? I have no idea how he would do that with no ability to travel there. I don't know in what time he hopes to have this cleared up but I don't think they'll be leaving anytime soon.
Either way I'm pretty sure he needs to resolve this in the child's first country of origin, the Philippines, before America will touch it.
Registering a child born abroad is difficult enough as it is with two parents. He hasn't made this easy for himself by waiting for so long.

I don't know how it works in extreme cases, but generally you start off with a cert from the hospital, then register the birth at the local Sangkat and get a birth certificate. Any other document you get will require a birth certificate and if it's for getting foreign citizenship it needs to be notarized. These are the procedures in place, I'm not sure how easy it is for foreign couples but there is no other way to do it, otherwise the child is in legal limbo and effectively stateless.

My foremost concern is that this incident triggers every red flag in place to prevent human trafficking. If I was working as a paper shuffler at the responsible department and this landed on my desk I would say that he probably bought the kid from the market. I'm sure he didn't but this is going to look very bizarre by the bureaucrat that receives the application.
Even if I received a DNA test proving family relation I would say that he forged it because it is so difficult to imagine that a foreigner doesn't register the birth of their child in a third country for 12 years.
He wrote that "the medical clinic which delivered Deacon so early feared action for malpractice and refused to issue a letter of birth". Can we accept this at face value? Is anybody in Cambodia shutting down medical clinics for malpractice because they admit women that are giving birth prematurely?

Exactly the same process when both parents are foreigners. I'm not a negative person, I encourage people all the time...it's usually to f**k off! But, whatever.
I believe there is more to the story of him being injured by illegal street racers than meets the eye. Jason had a history of getting into altercations on the road.

It is hard to fathom having a kid, and then languishing for 12 more years on a menial salary in Cambodia...instead of returning home and getting a real job to take care of your child.

What a fucking fuck up! Everyone , everywhere in the world registers the birth of a child unless you really are living in gutter. I find it very hard to believe that two educated parents between them failed to register the kid who when I met seemed very polite and in turn well brought up. Makes no sense unless it is a scam.

k440, something to do when you're pissed.
Registering the birth at the Sanghat office took a week and cost me 30$. Roughly a 24 and a 6 pack. Was like me buying 6 buckets of dill pickles.

My 30 y/o girlfriend had no birth certificate. She bought one from her village for $100. Actually, they gave it to her for free and she over tipped them with my money.
Any hospital or clinic in Cambodia that will deliver a baby can produce a birth certificate. You then take that to the Sangkat, then take the baby to the U.S. Embassy. It is easier than getting a driver's license.
