Buying land - advice
What are the steps one could and should take to ensure land is unencumbered and clear to be sold? Assuming a successful transfer and issuance of a district title, what documentation besides the soft title and sale contract is required to request the cadastre office come to issue a hard title, should I decide to go that route?
Land in question is rice paddy, and said by owner to be debt free and neighbours on all sides to be theirs and debt free, and they are all willing to thumbprint at district office to that effect. Existing soft title was allegedly lost in a commune office fire, which was corroborated by several people in the surrounding few km, who claim the same happened to their titles.
Any thoughts, horror stories, tips appreciated.

I'm fine with soft title but I wouldn't touch land without the papers unless it was selling for beer money. Owner needs to sort that.

This is my main concern. If we can supposedly get village and commune signatures during the sale process, and district title issued after the sale, why can't the current owner have their title remade? I would guess they didn't need it so the old yeay wouldn't have wasted her money / time, but what's a title cost? Some KH real estate websites say as little as 10 bucks for commune papers. I might suggest I will pay for them to have their title prepared with the sangkat before we proceed any further.
The most recent soft title converted to hard title that I saw was about 5k. Whilst hard title is good in terms of securing your title over the land it is bad in that transfer of hard title incurs a 4% transfer tax thus making your land less valuable when you sell it.

Have them replace the soft title. All the Cambodians I know keep their land titles to themselves, or it's in the bank as a collateral. I don't believe land titles were lost in a fire. Maybe the communal copy was, but not the owner's.

^ What he said. Put down a deposit, say 10% or $1000, whichever is less and say you will pay the remainder when the documents have been run through the commune and district offices (with you picking up the tab for the district part as that's not so normal in the boonies).
The only very slight risk is that someone who was not the person who sold it to you turning up with an older soft title.
That's very unlikely because the commune chief and district office will have some pretty tough questions to answer about how that happened.

Yes, not sure why they wouldn't have held the titles themselves, and whether they're referring to their own copy, or one on file at the commune office. I scoffed at it too at first mention, but a guy 2km down the road said the same had happened to him just 20 minutes later.
We had discussed with the owner not paying anything, except processing fees, until the village and commune heads had signed off, along with thumbprints of neighbours on all sides, and commune title prepared in our name. They agreed to this in principle, which puts me more at ease in getting the district papers.
re: hard titles, I read somewhere that it's closer to $1.5k to have a district title converted to hard title?

But ask another question first; concerning that rice field I referred to above, Sun Hen's little scout army are due sometime before April to rock up, measure it and hand out hard title gratis. Yes, I would definitely recommend trying to find this out before going and paying for the hard title. Have been issued hard titles gratis on two of our plots of land this year so far, and have been informed that the land surveyors will be beginning the process of surveying and mapping for hard title issuance in a district where we have another couple of plots at the start of next year.
