Cambodia will use the National Disaster Management Law to prosecute people who run away after testing positive for Covid-19. They will face 6 months in prison.
On Tuesday a Ministry of Justice spokesperson told The Cambodia China Times that the judiciary will use Article 44 of the National Disaster Management Law to severely punish people for spreading the epidemic.
Article 44 of the National Disaster Management Law says that if you are aware of the risk to cause a disaster and fail to report the information to the police immediately, you can be sentenced to prison for 1-6 months and face a ៛100,000-៛1,000,000 Riel fine ($25-$250).
He explained that the law covers deliberately hiding and evading quarantine after learning that the Covid-19 test is positive; assisting quarantined people escape; having contacted confirmed patients but deliberately concealing information.
It was asked whether the four Chinese women who escaped from Sokha Hotel to visit N8 nightclub during their mandatory quarantine period would be charged under the National Disaster Management law. He responded that the police are still investigating the case and will deal with it in accordance to their findings.
After the third wave of the epidemic broke out, Cambodia began to amend laws and introduced new regulations to severely punish those who violated the epidemic prevention regulations.
On February 18, Prime Minister Hun Sen signed the decree to amend Article 8 of the 2015 regulations on Prevention and Response to International Emergencies.
According to the new law evading quarantine, refusing to cooperate, deliberately concealing information and false reporting carries a fine of ៛1,000,000-៛5,000,000 (approximately $250-$1,250). The fines for the old regulation was around $50-$250.
According to the new law assisting someone to escape quarantine carries a fine of ៛10,000,000-៛50,000,000 ($2,500-$12,500). Leaving quarantine without authorization will result in a fine of ៛1,000,000-៛5,000,000 ($250-$1,250).
Additionally, the Cambodian government introduced new regulations on epidemic prevention on Monday. Foreigners in Cambodia who escape from quarantine or treatment and refuse to provide information for contact tracing will be deported and blacklisted permanently. Cambodian citizens who escape quarantine or treatment will face strict penalties. Businesses that refuse to cooperate with the authorities and hinder the prevention and control of the epidemic will be ordered to suspend their business.
