Land in Siem Reap: Is it under Apsara's Authority?
Morning K440ers,
I have bought a plot of land and is wondering is it under Apsara or not? From my knowledge talking to villagers next to my land, they said it is under Apsara, but from comparing the map location and zoning location, i believe it is not under Apsara. The land is about 3-4km south east of Angkor wat.
I have attached 2 links one is my land location and another is Apsara's zoning map.
Another question i have is, some villagers said that i can not build anything on the land? A few days ago, one of the villagers called me and said that i can build a small hut but i need to bribe the village and Apsara's authority.
This sound very alarming to me and would like to hear your inputs.
Oh one more important thing is that the land is under my partner's name (Cambodian).

I am very sure your land is in the Apsara authority zone as the border is highway 6. As elections are coming up, the rules have been relaxed and it is possible to build at the moment. The problem is that everybody is doing it and things like concrete, bricks, or wood are pretty much impossible to find.

If you look at the Apsara map around Angkor ( Blue/purple square), the land is south east of that and it is not in the zone 1-4.

I drive by there every day and the pillars marking the Apsara zone are way beyond where your land is. My F&B manager has land near there and was told he could not even build a wall around his property.

So what will happen if i build a small house on the land, currently the whole village is building on the land that belong to Apsara. Will they get demolished like Boeung Kak and Borir Kila in Phnom penh? Should i sell the land because keeping it and can't build anything is just a very bad idea. Sooner or later some random vilagers will build a house on it and take the land. We have a land transfer by the village head.

I cannot answer that. What I would be worried about is that they do allow construction at the moment to get votes but what happens once elections are over?

It's hard to tell from your map whether you're in Zone 1 or Zone 2, although I'm pretty certain you're at least in Zone 2. According to Article 6 of ROYAL DECREE NS/RKT/0199/18
In practise of course people buy and sell land informally out there all the time, or even semi-formally with soft title paperwork from the village/commune, and it's normally no problem so long as you don't push your luck and try anything stupid like cutting down big trees or building a two-storey concrete house or something. Still, it's worth bearing in mind that you're subject to the very arbitrary whims of the govt and you could have the land taken from you at any time.
So, you or your friend don't own the land.Zone 2 which is defined as " protected archaeological reserves " under Article 4 of Royal Decree N°001 NS dated 28 May 1994 belongs to the inalienable public domain of the State. Any land transfers or concessions which may have been made on the land of the said zones are null and void.

So we went there and saw everybody is building on their own plot of land, we decided to chip in and build a small concrete floor and wooden wall house and maybe build a fence for the land. No one there thinks that they will get evicted from the land so why not make the most out of it.

Sure, that’s what everyone living illegally in Zone 3 (along the river) thought until March last year also. A month later the Gendarmerie sorted that out and you see how it looks now.blackout wrote:No one there thinks that they will get evicted from the land so why not make the most out of it.
As Hanno correctly pointed out it’s all peace, love and happiness until July 28, but I wouldn’t build anything that you couldn’t afford to lose on July 29.

Your land is in Apsara zone 100% (regarding to the map)
Please note that 30 days before commune election 2017 you can build some structure ( you have time only 30 days)
than when national election you can build other 30day. in this period there is not the law or rule but Apsara Authority they busy only.
you may can build soft construction

It’s terrible info: it makes it seem like there is some kind of set policy to do with elections (there isn’t; it’s completely arbitrary and depends on the village chief, commune chief, whoever from APSARA comes to inspect, which way the election looks set to go, and any number of other factors).Canucklhead wrote:This is good info, but almost 4 years too late.

Besides, I wouldn’t trust any map especially at that scale and the general lack of cadastral knowledge among local map-makers re datums and projections and so on with a land purchase. The Land Department, or whatever it is, can be consulted somewhere near the roundabout on route 60, and will give you some kind of answer, but I wouldn’t touch anything until I had a piece of paper that said “hard title”.
By the way, all the land in the entirety of Siem Reap Province, by Royal Decree, is land under the authority of APSARA: There's a spectrum of different degrees of private vs. public ownership, but if you find a bunch of ancient bricks on your hard title private land, it isn’t yours any more.
Siemreaplandhouse needs to do a bit more research it seems. To take one example: this new hotel Jaya House River Park had the misfortune of building around the river (around which there is a buffer of several hundred meters which Is APSARA Zone 3) without consultation or approval and decided to use the public park as their car park, causing chaos and bitterness in the local community… which is a nice neighbourhood that includes various higher-ups in the government. That guy is an asshole and can get fucked. Don’t be that guy.

If the punk Sokhong aka Sokha Hotels and resort is allowed to build perhaps the biggest hotel in Cambodia less than 3km away from the main Angkor Wat temple, round up the villagers and demand the same...who knows, mr excellency might give it a green light esp the general election is just around the croner. There are a lot of mansions built with tall fences within 2km radius of the temples as long as I can remember and no APSARA wankers come to apply the rule. If you gonna go by the book is like communicating with a bunch of barbarians living in a cave.
