this will be interesting to see if they can convict them without looking like total idiots;

(July 8). -Defence lawyers of two Myanmar suspects accused of murdering two British tourists on Koh Tao challenged a police officer involved in the case over the reliability of his investigation as the trial opened yesterday

It's quite clear that looking like total idiots is not a concern to the current junta. It could be a daily summary of their shenanigans. My latest fave is the "we don't have enough money for health care" at the same time as "we must buy three submarines from China for a billion dollars".Phuket2006 wrote:this will be interesting to see if they can convict them without looking like total idiots;

JC;
we know ur position on the general.coup. am sure you would have been happy to have Thailand continue its downwards spiral before the coup,
but this is about two innocent scapegoats being tried for a crime.

- See more at: http://www.thephuketnews.com/key-dna-ev ... ooVKk.dpufThai police and prosecutors say DNA evidence points towards the two 22-year-old suspects, but the defence claims the men have been scapegoated by an under pressure police force who bungled their investigation and coerced confessions from the pair.
Much of the defence’s case revolves around a bid to retest key forensic evidence, including DNA on cigarettes and a condom found near the crime scene as well as DNA swabs taken from the victims' bodies.
"The DNA on the cigarettes is all finished," the head of police on the nearby island of Koh Pha Ngan told the defence team outside the courtroom on Koh Samui today.
"The DNA samples taken from the bodies are not my responsibility. They are in Bangkok," Police Lt Col Somsak Nurod added.
The court is due to rule tomorrow (July 10) on whether the swabs held at Thailand’s Central Institute of Forensic Science in Bangkok may be retested, the defence team told AFP.
"If they say [the DNA] is finished, it’s finished. Maybe our [forensic] expert will discuss on the stand whether it can be used or not. I don’t know," Lead defence lawyer Nakhon Chomphuchart said.

I'm with you on the scapegoating of these two poor buggers, and was right from the start.Phuket2006 wrote:JC;

And while I was no fan of Thaksin's, yes, I'm in favour of the democratic process and letting things take their course. When you allow mob rule to provide the military an excuse to subvert democracy, this outcome was inevitable. What pissed me off particularly about this go-round was the astonishing lack of perspective that seemed to precede and follow it, where people who really ought to have known better insisted that this was all somehow about Thaksin and just getting rid of him would sort the problem out and how this time the military were the right people and who were doing the right thing for the country (unlike all of the other military coups that preceded them). I said at the time it was just the same as before. It's only now that people are belatedly coming to the realization that they've been had yet again. When will they learn?

This just in - the defense wanted the DNA re-tested, and the Thai police say they can't because they lost it.
Seriously. You couldn't make this shit up.

I don't know whether it's poor reporting by the Phuket Times or just a different criminal legal system but the above struck me as bizarre - " The DNA on the cigarettes is all finished, the Head of the Police on the nearby island of Koh Phan Ngan told the defence team outside the courtroom on Koh Samui yesterday ".
Is the trial being conducted inside or outside the courtroom !
Really hope I'm wrong but I suppose it's too much to believe that justice will prevail. The family have kept their dignified silence but I hope the passing of time won't lessen the impact in the UK and elsewhere if the cover up succeeds, and they are given every media outlet possible to go for the authorities should that be their desire.
It's bad enough 2 lives have been lost it would be shameful if another 2 innocent victims suffer.

Speaking to the BBC, Lieutenant Colonel Somsak, who led the original investigation, said some of the original DNA samples had been "used up".
A hair sample found in Miss Witheridge's hand was among samples that were lost, he said.
Lieutenant Colonel Somsak said all police could offer the court was documentation of the results.
"There's nothing left. It was used up when we tested the first time," he said.
OK for those just tuning in, here is a recap:
1. The crime scene is totally contaminated with hundreds turning up for a media circus on the beach.
2. Headlines that the headman's son is wanted for the murder, the chief of police investigation is taken off the case then immediately the new chief on the case proclaims the headman's son innocent.
3. The police keep making contradictory statements to the media.
4. Headlines that a Scotsman flees the Island after allegedly being threatened and hounded by a "mafia" gang who threaten to pin the case on him and hang him in the woods.
5. A man claims he is allegedly beaten up and tortured by police trying to frame him for the murders.
6. Two Burmese young men make confessions then immediately allege they were beaten up and tortured to extract the confessions.
7. Confusion over ownership of mobile phones makes the evidence look weak.
8. The Prime Minister congratulates the police on a job well done!
9. The police claim the evidence is perfect.
10. The courts keep telling the police the evidence is not good enough to be presented in court and ask them to go back and improve their case.
11. Claims from Britain they have DNA evidence that contradicts the police DNA results.
12. The defense asks the court to re-examine the DNA but it has all gone missing or has been used up. Effectively, there is no DNA evidence for presentation to the court. Only the police word that it was "perfect"
13. The head of police threaten the defense team outside the court telling them they should be supporting the police not the accused!
outcome
they will be found guilty
they have to. otherwise to much face will be lost
Got to show the world that justice is swift and all the tourists can return and feel safe
than the right thing would be a Royal pardon, so they can return home
MY take
there is someone walking around out there that did it, wonder how he sleeps at night?

There was another thread on another forum about a young barang female pulled from the water in Thaland (Bikini clad in Pattaya or Samui) this year but I can't find and info in it.
Anyone know who she was?

Whether it's this guy, the Red Bull heir, the young girl that slammed a mini bus full to their death on the Bangkok expressway or the actress who drove her Merc into the back of the sleeping cop's car killing him last week, or the countless others that will predictably follow in their footsteps they no doubt sleep soundly in the knowledge that their money and influence will buy them immunity from actual prosecution to any reasonable degree. A bit of superficial window dressing when required at most. I love most things about living in the country but this is the one aspect that I genuinely hate about.
Wonder if the Okhna's enjoying a beer with Red Bull junior in Singapore.

Yeh but at least the coup swept away all the nasty corruption that benefited the lower orders. The natural order in Thailand has been restored
I came, I argued, I'm out
