Us visa for my wife
Hi y'all, ,
I am a American citizen who moved here 8 years ago. I now have 3 children with my newly wed wife. All three children got their US passport and social security card just recently. Now I want to move back to america with my 3 children who are now us citizens and my Khmer wife. Will my Khmer wife have any issues moving with us to the USA? Will she be able to get a visa easily.thanks for your help.

You need to file for CR-1

If you plan to move soon you need to prepare for your wife to join at a later date, may be a long time separated.

Thanks bro. I heard it may take up to a year. Is there any way to expedite the process. My kids are 2 months , 1 year and 2 years so they need their mother.
No, they don’t care about that as a reason to expedite. That’s been asked a few times on visa journey https://www.visajourney.com/forums/topi ... o-are-usc/

I did K-1 so a bit different. I had to leave her and our young son in Cambodia and wait for them to join 9 months later.

Also, how do I prove that I can take care of my family? I have a job lined up and my family has money. What is the easiest way to prove that I can take care of them?? I also declared taxes 2020 for the 1st time for my stimulus so my income was below 1000 since I haven't declared taxes for over 7 years while living here. I don't have money for a lawyer my family has money but I have to do this without their assistance unless it's crucial. Thanks

I arranged for employment in the USA before I returned from Cambodia. You can prove your income level through pay stubs, employment agreement or letter from the company confirming your status and wages. I can't recall what I provided, just giving what I think constitutes fair evidence. Income below 1K? So you barely worked in Cambodia or you filed incorrect taxes? BTW, income of up to $107,600 is not taxed (form 2555) so there would be no need to put a low number to avoid taxes.Khmerwifeneedvisa wrote: ↑Wed Jan 19, 2022 12:17 amThanks bro. You can do some more prior years taxes, just go here and click "prior years" https://www.freetaxusa.com/
I asked USCIS (immigration) about the situation with a young child (2 years old) and they don't care. My case was just processed as slow as everyone else. It was great waiting but on the plus side I saved significant money during the 9 months in USA before they joined me.

That was before the pandemic. There are backlogs now. It may take 16+ months.
The normal process is to file the petition with USCIS in the USA, and it sits in backlog there for many months before being processed and approved and sent on the embassy in Cambodia.
However, there is a faster process called "direct consular filing" that you should look into. When the American citizen resides in the foreign country and has a job offer requiring immediate relocation to the USA, then the American may be able to show "exceptional circumstances" permitting the American to file the petition directly with the foreign embassy, thus skipping the long USCIS processing waiting times.

I don't know if the embassy in Cambodia offers direct consular filing or if you would qualify.
You might want to email the consular section of the US embassy and ask about it, and highlight that you have a job offer requiring you to relocate the USA on short notice.

Thanks everyone. In order to not have to file taxes for 7 years I kept my taxes below 1000. I know that was not right but I didn't know how to file taxes properly and everything here was under the table working for my family business. I just needed the stimulus checks since the virus did devastate my business in Sihanoukvile and forcing me to move to phnompenh. So I filed 2020 taxes for the year and I was luck if I made over 1000 a month. If u don't have a paystub or job in USA how else can I prove that I am able to take care of my family. A certain amount in bank account or other assets here like my parents land which could be transferred into my name? Thanks everyone.
Actually my best friend in the USA is willing to cosign the financial part of it since I will be going there with my family so no job offer or job will be waiting. He makes 60000 a year. Can he do that and I wouldn't have to provide proof that I will be taking care of them. So any help would be
greatly appreciated.

Do you have a job lined up or not, as you’ve contradicted yourself?

I think you can do assets or have someone else as a sponsor. Go read https://www.boundless.com/immigration-r ... reen-card/
Read the form I-864
If you do income, you or the sponsor needs to exceed poverty levels.

Just out of interest ....what does it cost you Americans to get your partner visas ?
Aussie spouse visas cost AUD$7,000 and it isn't going down anytime soon.
Only a year and a bit more and the missus will be getting an Aussie passport. Been a long and winding road but well worth it.....
