Has anyone here had experience getting a Canadian birth certificate for their Canadian/Cambodian child? I have the information from the Canadian embassy in Thailand and am planning to make a trip with all the original required documents. My biggest concern is the lack of an official looking Cambodian birth certificate. The one we have seems very simple. They just had me fill in the the fields and signed off on it. Is that really good enough?
Thanks in advance for any advice/info.

Did you get the birth certificate at the hospital? We had our kids in Bangkok, and the hospitals there have all the basic forms ready to go, including certified translations. Doubtful this is the case if they were born in Cambodia, but if that's what is the only official birth record available, then try to get a stamp on it from whomever (if there is no stamp, it's not likely official) and go find a certified translator here who can give you an English language copy (also stamped). Try to get other evidence from the hospital if possible, including bills etc. Bring along whatever other records you have, especially marriage stuff, also translated, basically everything you'd bring if you were trying to get your wife into Canada on a visa. Include photos going back to demonstrate your long-term relationship.Ernie Goodguy wrote:Has anyone here had experience getting a Canadian birth certificate for their Canadian/Cambodian child? Shouldn't be a problem if she's not a bargirl. If she is, should still be okay, but they'll give you more hassle. They've seen so many they'll spot it immediately. If you lie, you'll likely get caught and then you're in deep shit as you're on record as lying to the Man, and all subsequent interactions with them will be on the basis of you being "the Liar".
It depends on what the form you have really is. If it is the form from the hospital it is not a Cambodian birth certificate. You take this form to the Sangkat and present it with yours and the mothers ID etc to get the official birth certificate. This is an official form with a crest on the top, box in the middle with details of the father and mother as well as the child, and official signature and date properly chopped at the bottom. Sangkat should give you several official stamped copies for us in situations like this. The only english on the form should be the names of the child, mother and father [and they are also there in Khmer]. Can't remember the cost - probably $20 or so.
I am surprised you can get an official Canadian birth certificate. Australians born outside Australia aren't entitled to birth certificates - what you get is a certificate of Citizenship by Descent, which serves a similar purpose but doesn't have the details in a birth certificate, only the name of the child. In Australia I had to produce the Cambodian certificate and translation when registering the kids for Medicare etc, but there were never problems.

Make sure that the English is translated into Khmer correctly....my son's Sangkat birth certificate translated my name from English to Khmer as "unperSAN" not "unperSON" when it came to translating it the embassy recommended translation office said that they had to translate it as it read in Khmer and back into English and therefore the 2 names would differ and the British embassy would not accept it.Spad wrote:The only english on the form should be the names of the child, mother and father [and they are also there in Khmer]
So back to the Sangkat to get it done again!

As already stated, that isn't a birth cert, it's most likely just a birth registration. As far as I know you are supposed to get a proper birth cert from the Sangkat within a certain period of time, or fines start accumulating. I paid a small fortune for my kid's birth cert because I left it so long.Ernie wrote:My biggest concern is the lack of an official looking Cambodian birth certificate. I would be too, surely a birth certificate can only be issued in the country of birth?Spad wrote: I am surprised you can get an official Canadian birth certificate.
I had to do the same, they put my kid's name in the wrong order. So back to the Sangkat to get it done again!

Hi all,
Thanks for the info. So far you've saved me an ill-prepared trip.
The form I have from the embassy is an "Application for a Citizenship Certificate (Proof of citizenship)", which I thought equated to a birth certificate. If you want all the details I can send you a copy of the pdf(s) if you send me a message with your email.

Yes my two kids have the Australian equivalent of that [Certificate of Citizenship by Descent] - just the same as a birth certificate when applying for a passport or proving citizenship but [unless the Canadian cert if different to the oz one] no details of birth date, place of birth, parents etc. So not good in some circumstances at all - so the poor little sods need three pieces of paper [cert of citizenship, Khmer birth certificate, good english translation of same]!

A birth certificate is issued by the (Canadian) province or territory of birth. Obviously this doesn't apply for a child born outside of Canada. I think what you want is a Certificate of Canadian Citizenship. A child born abroad who has at least one parent that is a Canadian citizen is also entitled to Canadian citizenship. Sorry to go off topic but would a child born with a Cambodian mother and US father also be eligble for immediate American citizenship, regardless of marital status.

any child born of an American, anywhere is an American MY daughter was born here in Thailand and even though her mom an I were not married at the time, she has US citizenship and passport.
You need to obtain from the us embassy a , "Report of Birth abroad " document. If ur not married u only need two people to verify that u were/are together and to the best of their knowledge the child is urs. Note ur name MUST also appear on the BC.

That is also true for an Australian that acquired citizenship by descent must spend 2 years within Australia before their children could also gain citizenship by descent.jm wrote:There is some small print. HUH?? when did this come into effect? MY daughter has held a us passport since she was 8 months old and out of 17 years 9 months has only lived there 14 months in total timejm wrote:There is some small print. did some looking;
Under certain circumstances, children may acquire U.S. citizenship from their parents. The following conditions affect children born outside the U.S. and its outlying possessions to married parents # If one parent is a U.S. citizen and the other parent is a U.S. national, the child is a citizen if the U.S. citizen parent has lived in the U.S. for a continuous period of at least one year prior to the child's birth
# If one parent is a U.S. citizen and the other parent is not, the child is a citizen if
* the U.S. citizen parent has been "physically present"[6] in the U.S. before the child's birth for a total period of at least five years, and
* at least two of those five years were after the U.S. citizen parent's fourteenth birthday.
I didn't meet that has left the us in 1982 and my daughter was born 1994 and at the time of birth we were not married
Children born overseas out of wedlock
8 U.S.C. § 1409 paragraph (a) provides that children born to American fathers unmarried to the children's non-American mothers are considered U.S. citizens only if the father meets the "physical presence" conditions described above, and the father takes several actions:
* Unless deceased, has agreed to provide financial support to the child until he reaches 18,
* Establish paternity by clear and convincing evidence and, while the person is under the age of 18 years
o the person is legitimated under the law of the person’s residence or domicile,
o the father acknowledges paternity of the person in writing under oath, or
o the paternity of the person is established by adjudication of a competent court.
+ 8 U.S.C. § 1409 paragraph (a) provides that acknowledgement of paternity can be shown by acknowledging paternity under oath and in writing; having the issue adjudicated by a court; or having the child otherwise "legitimated" by law.
Ahh so as i stated first my name was on the BC and was issued a report of birth abroad doc for my daughter
But i DID not meet the physical presence test. Wonder when this came into effect?? i do see this:
[/quote][/quote]This distinction between unwed American fathers and American mothers was constructed and reaffirmed by Congres........In 2001, the Supreme Court, by 5-4 majority in Tuan Anh Nguyen v. INS, first established the constitutionality of this gender distinction.
