Hi
I'm not getting along with my landlord. It's not cut and dried. I think we all irritate each other. The family live downstairs. Sure, they're probably not all assholes, and I'm probably not as holy as I think...
It's a long story of an acumulation of aversion, but basically.
Theyve proposed i move out. In fact one suggested I do so tomorrow, coincidentallty the end of the rental month.
No mention of my $390 deposit has been made, and I assume, that this is something I contractually lose.
I think think they think they're going to squeeze me out and get a free $390, which is why they probably have been winding me up.
There's this gaslighting game where they admonish me for locking my bike, something I'm not supposed to do, and to the best of my knowledge this is not something I am doing.. I frequently find myself second-guessing, yet it is a constant point of argument... perhaps I do it on odd occasion, but not ALWAYS as it the constant claim. Am I losing my mind??
Other points are when I have left my helmet downstairs, a non cheap helmet, parts of the moulding at the base has been chipped off by the security guy downstairs progressively more. The landlord of course puts it on me. Any problem of theirs is somehow my fault.
My apartment flooded because the drain was clogged, and I think they knew it was going to happen because they were onto it before I even could alert them to it.
My real estate agent has been conspicuously absent and the landlord told me that the agent told them I dislike their family and so on. The agent that is supposed to represent my interests... yet they dont respond and they seem to be feeding the landlord nasty gossip.
This is a source of frustration because I am expected to do things and the agent isnt there to verify the validity of these things or even there to negotiate basic repairs. The one time I did get in touch with the agent they said, "just talk to the landlord."
I really cant get in touch with my agent and I may have to give the office a visit tomorrow.
$390 is a lot of money to lose. I've only been here three months too.
I understand this is not something that warrants a great response but appreciate any advice.
It seems I have no allies in this. Back in australia there's a tenants association that handles any problems like this, with strict guidelines and laws. I'm guessing this is not the case here.

No idea what you mean about not locking your bike. Anyway, if communication has broken down that much I think you are fuct. However if I was you I'd do my best to get the deposit back, or at least some of it. Or just stay there without paying till the deposit is gone. You should really figure out what your landlord is like before you move in. I've never had any issues like that here, always had landladies and they've all been pretty sweet.

What agent did you use? Most are not actually agents, they just scour streets for rentals and get finders fees, and most won't give a flying fuck about your troubles. They'll happily suggest a new place for you to move though - and another juicy commission for themselves.
If the landlord is suggesting you leave, there's no reason to suggest he won't refund your deposit. He's probably just tired of you expecting what you're used to at home.
There is no Residential Tenancies Bond Authority holding your deposit, just the landlord. Go and tell him you'll move out as soon as you've received your deposit back.
If he refuses and your agent can't resolve by the end of the week, move out anyway.
Did you sign a long term lease? Next time negotiate month to month or 3 month blocks so you have some flexibility.

Tell them you'll move out as soon as they return the deposit, if they refuse to return it tell them you'll stay one more month and will use the deposit to cover the rent.

1. Real Estate Agents represent and work in the best interests of themselves, period.
2. You are from Australia, $390 is not even a days pay, it is not a lot to loose.
3. Cut your losses and move out asap, do not fight on for the moral victory as it will be a Pyrrhic victory at best.

I would say that you should definitely try to get your deposit back. If you haven't even asked them yet, how can you know what they will respond? Do you have a written contract and receipts? If you don't have a written contract, that's a learning experience you'll want to adjust next time.
It's possible that they want you to move out because they need to do work on your apartment, especially since you mentioned flooding. I once had to move out of an apartment because of a plumbing problem- at first I thought the landlords were being jerks but in retrospect I think they really needed to fix it.
As for gaslighting, yes I think it's possible they are doing that. You could try parking your bike in a pay to park place until you move out- it's usually just like $5 per month.
Just talk to them calmly and try to negotiate calmly. Khmer people like to stay calm. If there is Khmer person that can help to talk with them that will help balance the situation and make them feel they can't outnumber you/badger you.

You'll all be happy to know, they evicted me the next day with full deposit paid promptly. It wasn't working out for everyone. It became clear they were trying to squeeze me out for some reason I dont know. I'm not the sedate married couple they're wanting perhaps. They were so nice when I had packed and was on my way. THe son-in-law said, "Hope to see you around here soon." I found a better equilibrium in Sihanoukville. Cheers.
