titles, ownership? etc..
some years ago the wife bought the folks some land out in the sticks..authorities came along thereafter, subdivided and converted to hard title...everybody in the family (except wife who was not around) got a plot...all good...
when one of the siblings recently played up (post marriage nasty husband) and things came to a bit of a head the wife managed to convince said sibling to give back and "transfer her ownership" to wife...done at the sangkat as a contract with all present, witnesses, thumbprints etc..wife took possession of contract and hard title...
i'm guessing that such an arrangement has legal currency but only at the local level (possessory right as with a soft title) but does it alter "ownership"?
I imagine that in any future local transactions physical possession of this contract and title would be sufficient to enact a sale but if it's a transaction requiring transfer of hard title the sibling in this case would have to sign...would this be right?...and if so, what if she's nowhere to be found?..
and generally would this apply to all transactions where there has been a sale (accompanied by a contract) but the title deed has remained unaltered?

Hard title trumps any local agreement, which is what she has. At the end of the day it's who's name is on the hard title.
If he (the estranged husband) contests it then there may be trouble ahead.

that's my understanding and in the absence of precedent i imagine there might be some conjecture..the husband's contentious only to the extent that he's disrespectful of the in-laws..there were rumours that he'd try and get himself on the title..

If they're married then I'd imagine he has equal legal rights, to that land. It's not about who owns it but in the future when his wife wants to sell then it'll be an issue.

issue now if she only got it at local level. my ex-girl originally bought hard title land and got it locally transferred (i was an idiot then). when we broke up, i *asked* for it back, and i had to trace back to the name on the hard title and get him to transfer it, (all those names in between written on notebook paper didn't mean shit, but it did help proving she purchased it so he was willing to do it and not screw me over, but i had to pay for the transfer).
maybe your wife just cheaped out or is ignorant of the law, because its more expensive and takes longer to change hard titles over.
also i was told if the dude (who's name was on the title) was dead or couldn't be found, it would of taken even more money and time and hassle. just do it legit if the land is worth something.
but if you get a dude who doesn't know the law and just bought it locally, then maybe you get lucky and can sell it. but if you get someone like me who wants the hard deed legit, then she better be found to sign it over.

I think it gets done partly to save on costs but also because that's the way things were done for a long time...and as long as no one is fussing about hard titles everyone's happy...
