Don't Start a Business in Cambodia
A German national/expat who resides in Sihanoukville and is/was owner/designer/builder of a quality resort on Ko Rong was arrested at court and placed in jail by order of a judge in Sihanoukville. A tuk-tuk driver who had befriended the German years ago and had done paid work for him claims he is the rightful owner of the resort. The tuk-tuk driver has no paperwork and/or contract to show he is a partner and/or owner, but the judge awarded him the resort and jailed the German expat.(the Cambodian can now sell anything at the resort he wants even though the German expat can show he built it with his money) It should be noted that just before going to court the tuk-tuk driver sold his house/property, now way would he need a large amount of money just before facing a Cambodian judge??
Also of note is that the German expat was a partner in a fast ferry business that recently brought a large/quality alum. fast ferry from Thailand to carry passenger to the islands. It seems that a high government official's son also has a fast ferry service run out of Sihanoukville and this new ferry system would have been in competition with his slower ferries.. From the very start the government placed roadblocks into the way of the new ferry service, forced it to stop running at times and eventually impounded the very expensive new ferry/vessel, stating that the "import duty" was not paid, when in fact paperwork shows it was paid. The new ferry service has stopped running by order of the government (same governmnet the other ferry systems owner's father is a high official at.)
One has to wonder if there is any connection between these events as the tuk-tuk driver only recently came forward with his unsubstantiated claims only after the announcement of the new fast ferry service (TIC- This is Cambodia. Unless you are a Chinese national with lots of black money, don't start a business in Cambodia.)

How can the German claim to own the land on Koh Rong? Did he have a lease? Was his claim to the land registered anywhere with a Sangkat before he invested significant money in construction? Did he have his paperwork done by a good PP lawyer?
One of the reasons I have never invested there is that I do not like the security of tenure offered there.

Would be nice to have some names here. The German's name for instance. His FB. The beach and name of resort being built on Koh Rong. The name of the lessor and lessee too would be nice. At least then we could dig deeper if desired.

It goes without saying that there is a lease and it was registered with the Sangkat. Anyone asking that question is business clueless in Cambodia. Yes, good attorney, but corrupt paid off judge and lots of owner/lessee paperwork. Name later after he is out of jail as people in Cambodian jails have a tendency to commit suicide or have "heart attacks" while in custody. Moonlight Resort/Ko Rong and SeaCambodia (ferry that was running in competition to the high government official's son's slower passenger ferries.) Very hard to start a business against a high government official. Need more, maybe read it in the newspapers soon.
Was that Koh Rong or Koh Rong Sanloem? One registered on Sanloem but not Rong.
So what is he actually arrested or in custody for? Building on land that he has no lease for? I doubt that one. Non payment of import taxes? I doubt that too. Someone setting him up as revenge? Possible.
Is there a connection you ask? Probably.

Give them the new boat in exchange for his resort and they may do a deal. Fight a Khmer in court and you will lose.

ummm... no.
Lots of people invest significant amounts based on the advice of "friends" including nice trustworthy tuk tuk drivers they have met in Cambodia. They trust their friend to do all the paperwork etc etc. .. and guess what happens with alarming regularity?
You were not specific. You said he owned the resort. It was not clear if it was owned the title or a leasehold only. Many people have
leases that are not registered with the sangkat or if hard title with the land registry.
I realise you are an expert on this.....
...and before you say Barangs cannot own land ... well I have control of several properties including land.
If you think I am clueless about business in Cambodia ... well what business' have you owned or started?
To make a blanket statement that no one should start a business in Cambodia because one person got screwed is just plain wrong. I have had several successful ones and successful property investments and not been screwed like your friend.... yet.

Never ever ever become "friends" with a tuk tuk driver. Nothing good can come of it.

the only thing is they spread so much fairydust in most peoples eyes.. most of us have absolutely no clue what is really going on in this country.
I have spoken so many times with locals who told me this..
don't forget the Russian Bilionaire who slapped one of his staff, oh immediately he had to go to court and paid heavily with prison term and money !
It doesn't matter who you are.. they will always try to screw us. Why you think there are so many laws here..
I meet often guys here who think it is lawless here.. yes it is for the locals..!! but for us they have more laws and rules you can imagine.. All to be used against us when needed.. They always want to win and their pride is sick!
if your business goes to well.. if your farm goes to well.. if you try to renovate your house, everything !
