Hai, i want to buy a second hand motorcycle about less than 120cc. I have no knowledge about the motorcycle. Somehow, i went to the second hand motorcycle shop and the dealer told me no need pay any tax for the motorcycle. But, when i asked a motor seller from "khmer24.com", he said need pay tax for the motorcycle.
So i just wonder why some motorcycle has to pay tax and some no need? How to differentiate?..Im so confuse!

If it has plates and a registration card, import tax has been paid.
If it doesn't have either, then import tax hasn't been paid.
Don't bother with bikes without plates and registration.
I read somewhere of proposed changes so that foreigners could no longer register used bikes, so if that's true, you won't be able to complete the process for a used bike without plates and tax.

I think the proposed changes is not an issue. I have ask few personal seller on "Khmer24.com" about buying their used motorcycle, they told me just pAy the cash to buy their motorcycle enough, dont need any of my personal details like passport or driving license.

The short answer is no one really knows. Historically it hasn’t been an issue, my motorbike is registered in someone else’s name - I have the reg card in my possession.
However, the recent change in law preventing foreigners from registering used motos in their own name is interesting. I don’t understand what their rationale is for that law & what may be coming along in the pipeline. And even if there are new laws in plan no one knows if they will be enforced.

Buying with plates and registration is fine at present, and is unlikely to to be a problem in the future unless they start enforcing the ownership change rules.
But, if you buy a used bike without plates, you can't get platesbas per the recent changes. Without plates and proof of ownership (registration), the police can and probably will sieze your bike at some point.

If you are in possession of the actual motorbike and the registration card that matches the bike, even in the eyes of the police, you are considered the owner of the bike. A lot of times, Khmer never bothered to go change the registration on used motos. So if the bike has plates and a registration card, you are good to go. The few times I bought used motorcycles, I would always write up a sales contract that also stated that the person selling me the bike was the legal and fair owner.
Also, always make laminated copies of the registration card at a copy shop as you don't want to lose the original.
